Terms and Conditions
Memory Lane Photography will provide photographic coverage of the wedding/event on the contracted date and time. Coverage time selected is set forth in the contract.
This contract may be amended with the mutual consent of both the Client and Memory Lane Photography. Any amendments to this Contract must be in writing, signed by both the Client and Memory Lane Photography, and physically attached to both copies of the original Contract.
This Contract is not valid until it is signed by the Client and Memory Lane Photography, and has been received along with payment of the booking deposit. This Contract incorporates the entire understanding between the Client and Memory Lane Photography. Each person signing the Contract will be fully responsible for ensuring that full payment is made according to the terms of this Contract. This Contract is governed by the laws of the State of Idaho. Only Memory Lane Photography and the Client can discuss any issues that may arise.
Change of Date or Venue:
Memory Lane Photography should be notified immediately of any changes in schedule or location. Such notification can be made by phone and a confirmation sent via e-mail for documentation purposes. Memory Lane Photography will not be held responsible for non-coverage of the event due to failure of the Client to notify Memory Lane Photography of a change in schedule or venue. In the event of a change of Client's contact information, Client must notify Memory Lane Photography.
Images are edited at Memory Lane Photography's discretion, and delivered prints may not include all images shot. Memory Lane Photography reserves the creative right to edit and release only those deemed creditable as professional in quality and within the Photographer's artistic standards.
Memory Lane Photography shall be the exclusive photographer retained by the Client for the purpose of photographing the wedding/event. Family, friends, and other guests of the Client and other wedding/event vendors shall not interfere with the Photographer's duties. In the event interference takes place, guests will be asked by Client to refrain from taking flash photographs at certain intervals of the wedding/event to ensure proper exposure of images. Memory Lane Photography is not responsible for lost or undesirable images due to obstruction or interference by family, friends, and other guests. Client agrees that it will be the responsibility of Client to ensure enforcement of this policy. The Photographer reserves the right to remove spectators who interfere with the Photographer's duties.
Product Delivery and Price Lock:
Upon notification, the Client must arrange for pickup of the CD/DVD(s) within a reasonable time period, not to exceed 30 days after notification by Memory Lane Photography. Memory Lane Photography is not responsible for any damage that may occur while the CD/DVD(s) are in storage after 30 days. Client shall not hold Memory Lane Photography liable in the event that photographic materials are damaged in the process, lost/damaged in the mail, or otherwise lost or damaged without fault on the part of the Photographer. No money will be reimbursed.
Upon your signature and receipt of the deposit, Memory Lane Photography will reserve the time and date of your wedding/event, and will not make other reservations for that time and date. For this reason, the deposit of one-half (1/2) of the total package price is non-refundable, even if the date is changed or wedding/event cancelled for any reason. No date is reserved until the deposit is received. The deposit is applied towards the contracted wedding/event photography pricing package.
Payment of Balance Due:
Client understands and agrees that the entire amount owed for the wedding/event photography package described in the Contract is due no later than seven (7) days prior to the wedding/event date. Client agrees if the balance is not paid by this time, and if no other arrangements have been made, Memory Lane Photography will NOT photograph the wedding/event, with no liability to the Photographer and loss of the booking deposit by Client. Additional hours worked by Memory Lane Photography beyond the number of hours contracted as stated in this Contract will be charged at the rate of $50.00 per hour, to be paid prior to the end of the contracted coverage time.
Termination and Cancellation:
This Contract may be terminated under any of the following conditions:
A. At the Client's Discretion
Client understands that pursuant to this Contract, Memory Lane Photography will forego opportunities to book other business on the wedding/event date. Client understands that in exchange for this consideration, Client agrees to the following scenarios with regard to refunds/application of monies paid by Client to Memory Lane Photography.
(i) In the event the Client reschedules the wedding/event and Memory Lane Photography has the new date available for booking, the Client's booking deposit will be transferred to the new event date, and the original remaining balance will still be due within seven (7) days of the wedding/event date.
(ii) In the event the Client reschedules the wedding/event and Memory Lane Photography is NOT available on the new date, the Client's booking deposit will be applied as a credit to any future shoots. The booking retainer will NOT be refunded because Memory Lane Photography has now lost the business revenue from the original date.
(iii) In the event the Client cancels the wedding/event outright, Client will forfeit the non-refundable booking deposit. Cancellation must be made in writing, even if a phone call is made, to inform Memory Lane Photography of the cancellation.
B. At Memory Lane Photography's Discretion
In the highly unlikely event that Memory Lane Photography becomes unavailable to provide the serves described in this Contract on the wedding/event date for any reason, including, but not limited to, illness, injury, emergency, or natural disaster and/or sudden event beyond the control of Memory Lane Photography, a substitute photographer can be recommended, but availability is not guaranteed. This Contract will be transferable to said substitute photographer. If the Client declines the substitute photographer, the Client may instead terminate this Contract, and receive a full refund of all monies paid to Memory Lane Photography.
C. Return of Monies Paid
In the event that any refunds are due under the terms of this Contract, Memory Lane Photography will effect such refunds to the person or entity from whom or which the funds derived within thirty (30) days of (a) the termination of the Contract; or (b) the conclusion of the wedding/event date.
Touch-Ups and Creative Enhancements (a/k/a "editing"):
Basic retouching and creative enhancements are provided and are included in the fee. Although diligent efforts are made to avoid environmental problems and effects, all Client-requested digital touch-ups or alternations not included in the purchased product are at Client's expense and would be defined as premier retouching. Premier retouching includes, but is not limited to, small lines and wrinkles, teeth whitening, red eyes and face reduction, skin softening, correction of hair/make-up, environmental effects, clothing, reflections in glasses, etc. Premier retouching or extensive touch-ups will incur a $50 per hour fee.
This Contract, including any exhibits and other attachments hereto, constitutes the entire Contract with respect to its subject matter and supersedes any and all prior or contemporaneous representations, understandings, and contracts, whether oral or written, between the parties relating to the subject matter of this Contract. The section and paragraph headings used in this Contract are inserted for convenience only, and shall not affect the meaning or interpretation of this Contract. All amendments or modifications to this Contract shall be binding upon the parties so long as such amendments or modifications are in writing and executed by both parties.
Returned checks are subject to a $50.00 return check fee. Client assumes responsibility for any and all collection costs and legal fees incurred by Memory Lane Photography in the event enforcement of this Contract becomes necessary.
